In the Matter of the Legal Profession Act and a hearing concerning ANTHONY JOSEPH JASICH
As the saying goes, '
'Oh what a tangled web we weave when first we practice to deceive'' could not be more appropriate in the following case, which involves many players that are placed in position of trusted servants.
The complaint by
The Law Society of B.C. , against retired member Mr.
ANTHONY JASICH is a perfect example of a legal and justice system working together at the detriment of the public's interest.
In effect, the entire system of courts and (quasi-courts) in Canada have given the appearance that it is run by the legal establishment to serve the legal establishment and the criminals only.
J4Y is informed that Mr. Jasich's,
84 years of age, has been involved on a case, since 2006, as a pro bono legal adviser, for
Mr. Harold Gaffney.
It all began with a fraudulent bankruptcy, which
Mrs. Sheila Gaffney, wife of Harold Gaffney, was assigned too, by
bankruptcy trustee Kenneth Rowan.
According to the documents filed in court --
IN THE MATTER OF THE BANKRUPTCY AND INSOLVENCY ACT OF SHEILA FRANCES GAFFNEY Docket Number
B052161-- Mrs. Gaffney, fabricated debts that did not exist, and concealed assets that ought to have been included in her Statement of Affairs.
One of the many concealment made by Mrs. Gaffney was the fact that after being assigned into bankruptcy in May of 2005, she was to start collecting her old age pension a couple of months later, by collecting over $6,000 more a year with her pension, making it close to $40,000.00 a year.
Further, Mrs. Gaffney and
trustee Kenneth A. Rowan valued the immovable property at
312-450 Bromley Street, City of Coquitalm, B.C. for
$134,000.00, which was less than the market value, for the purpose of passing her off as a bankrupt.
One month after Mrs. Gaffney was assigned into bankruptcy,
Trustee Ken Rowan, transfered her undivided half interest to his name and valued the property at
$190,000.00, which was $50,000.00 more than what was originally included in Mrs. Gaffney's Statement of Affairs.
From the time the title was intentionally severed from
joint tenants to
tenants in common, by Trustee Ken Rowan, with the full cooperation of Mrs. Gaffney, the property became the focal point, for the lawyers, and for
CIBC MORTGAGES INC, the financial Institution holding the mortgage.
Mr. Gaffney continued to pay his mortgage, contrary to the wishes of
trustee Ken Rowan, the lawyer for Mrs. Gaffney
R. Keith Oliver, and of
CIBC MORTGAGES INC.
Within less than a year Mrs. Gaffney was discharged from her bankruptcy, by
court registrar Levert who did not have the credentials nor the power to do so.
After Mrs. Gaffney was discharged from her fraudulent bankruptcy, her lawyer
R. Keith Oliver began an action under the
Partition of Property Act, to have the condo at 312-450 Bromley Street sold, notwithstanding the fact that
neither Mr. Gaffney nor Mrs. Gaffney have begun any Matrimonial Proceedings.
This is to say that in order for any and all assets to be distributed amongst spouses,
section 56 of
The Family Relations Act [RBC] must be invoked by either spouses, otherwise assets, unless agreed amongst spouses, cannot be split up.

The complaint against Mr. Jasich appears to be,
inter alia, personal.

J4Y says this since Mr. Jasich, has for some years, tried to get his peers at the Law Society to abide by the laws of this country.
The excuse to go after Mr. Jasich is that according to the complainant
CIBC lawyer Stephen Alsace, , Mr. Jasish provided bad legal advice to Mr. Gaffney, in a matter of mortgage and property, notwithstanding the fact that, Mr. Jasich claims the mortgage discharge of Mr. Gaffney's property is a fraud.
In the complaint, J4Y was informed that a letter was included, which was than published to Mr. Jasich and to others, by LSBC lawyer
Ruth Long.

Ms. Shelley Ion, the junior of
Ms. Ruth Long of the
The Law Society of B.C., and the same officer who responded to Mr. Gaffney's complaint against
D. Ross McGowan , by claiming he did no wrong, wrote a letter to
Anthony Jasich, advising him that she was referring the matter to the Discipline Committee of the benchers for review at the committee's meeting of May 7, 2009.
The letter from Ms. Ion, attached herein, appeared has though it was a bullying tactic from
The LSBC to stop Mr. Jasich in being Mr. Gaffney's pro bono counsel, as no one contacted him to set a hearing date, in accordance with
The Law Society Rules, until
September 21, 2009, wherein the LSBC finally served Mr. Jasich with a formal notice,
signed by Stuart Cameron, The Director of Discipline, of The Law Society of B.C.

The Discipline Committee in effect authorized an extension of time to serve Mr. Jasich the
Citation to September 30, 2009, after it had served Mr. Jasich more that 90 days after the date of the Citation.
Law Society Rules section 4-15 (1) (b).
Thus, from J4Y's point of view,
The LSBC has given the appearance that:
1. It is persecuting Mr. Anthony Jasich;
And
The Law Societty of B.C. further gives the appearance that:
1. It is trying to build a case against Mr. Jasich by
downloading letters from this Web Site and failing to download all evidence necessary for a just hearing.
2. It is acting in the best interest and on behalf of client
Harold Gaffney, when in truth, Mr. Gaffney did not, at any time, make a complaint against Mr. Jasich, but rather made several complaints against lawyers directly and indirectly involved in the matter of the Property of Mr. Gaffney, namely,
D. ROSS MCGOWAN,WILLIAM CADMAN,
R. KEITH OLIVER.
